Official Picks rules

Notice: These Official Picks Rules (“Rules”) form part of the Terms of Service of Fos SM Ltd (“FOS Social,” “we,” “our,” or “us”). By participating in Picks — whether free or paid — you agree to these Rules, the Terms of Service, the Community Guidelines, the Referral & Rewards Policy, and all applicable laws and regulations.

1. Purpose of Picks

1.1 Picks are a core feature of the FOS Social Platform that allow users to showcase, vote on, and compete with content in both free and paid participation formats.
 1.2 Picks are designed solely for entertainment, community engagement, and content discovery. They are not gambling products, games of chance, or financial instruments, and must not be used or promoted as such.

2. Types of Picks

2.1 Free Daily Picks: Each verified user may cast one free Pick per day per content category.
 2.2 Paid Pick Packs: Users may purchase additional Picks in packs via in-app purchase through the Apple App Store or Google Play Store, or as part of Premium and Premium+ packs. Current pricing (subject to change with notice) is:

$5.99 – 3 Picks

$19.99 – 10 Picks

$39.99 – 20 Picks

$150 (discounted to $75 during promotions) – 100 Picks

2.3 Pricing and pack availability may change over time. Any updated rates will be announced in-app and on the Platform before they take effect.

3. Eligibility

3.1 Picks are available only to verified users located in jurisdictions where participation is lawful.
 3.2 Users under 17, or those who fail age or identity verification, cannot purchase or use Picks.
 3.3 FOS Social may suspend or restrict Picks access for any account involved in fraud, manipulation, Terms violations, or abuse.

4. Voting & Competitions

4.1 Each Pick cast is final and irreversible — it cannot be withdrawn, reassigned, or refunded.
 4.2 Winners are determined by the highest number of valid Picks received within the competition window.
 4.3 In the event of a tie:

(a) the winner will be the entry with the highest number of unique voters; and

(b) if still tied, the winner will be the entry with the earliest timestamp of the final Pick.
 4.4 FOS Social reserves the right to audit results, disqualify manipulated votes, and verify outcomes before declaring winners.

5. Anti-Fraud & Abuse

5.1 The following activities are strictly prohibited:

Automated voting, bots, or scripts.

Creating or using multiple accounts to exploit Picks.

Collusion, vote-trading, or coordinated manipulation.

Selling, transferring, or reselling Picks.

5.2 We use technical safeguards and human review, including device fingerprinting, IP monitoring, and transaction analysis, to detect and prevent abuse.
 5.3 Consequences for suspected abuse may include:

Invalidation of affected Picks.

Suspension or termination of accounts.

Withholding or clawing back rewards and payouts.

Referral to payment partners, regulators, or law enforcement.

6. Prizes & Recognition

6.1 Winning users or content may be featured in-app, on the website, or in official promotional campaigns.
 6.2 By participating in Picks, you grant FOS Social a non-exclusive, royalty-free licence to display your username, profile, and content for publicity and promotional purposes.
 6.3 Prizes (if offered) are non-transferable, cannot be exchanged for cash, and may be substituted at our discretion unless required otherwise by law.

7. Purchases & Refunds

7.1 All paid Pick purchases are final and non-refundable.
 7.2 Purchased Picks do not expire and remain valid unless your account is suspended or terminated.
 7.3 If Picks become unavailable due to a service failure caused by FOS Social, we may, at our discretion, issue replacement Picks or equivalent compensation.

8. Liability & Disclaimers

8.1 Picks are an entertainment feature — not an investment product, gambling service, or financial instrument.
 8.2 FOS Social is not liable for losses, disputes between users, or missed opportunities related to Picks participation.
 8.3 To the fullest extent permitted by law, liability for Picks is excluded or limited as described in the Terms of Service.

9. Termination & Changes

9.1 FOS Social may suspend or discontinue Picks at any time and without liability, subject to refund of unused paid Picks where legally required.
 9.2 We may amend these Rules periodically. Material updates will be communicated in-app or by email, and continued use after the effective date constitutes acceptance.

10. Governing Terms

10.1 These Rules form part of and are governed by the FOS Social Terms of Service. In the event of a conflict, the Terms prevail.
 10.2 Disputes relating to Picks will be resolved in accordance with the dispute resolution clause of the Terms of Service.
