Subscription & Payment Policy

This Policy explains how subscriptions, one-off purchases, discounts, fees, taxes, refunds, chargebacks, reserves, and payouts work on FOS Social. It forms part of the Terms of Service and should be read with the other policies listed or incorporated on our website. All purchases on the Platform are made exclusively through in-app purchases via the Apple App Store or Google Play Store.
Who can pay or get paid
1.1 Minimum age & verification. You must be 17+ to purchase on the Platform. Users aged 17 or any unverified users cannot access Sensitive Content or use payment/payout features until they pass our verification checks.
1.2 Creators. Only verified Creators may monetise content or request payouts. We may ask for government ID, selfie/liveness checks (with consent) or a non-biometric alternative, and tax/payee forms where required.
1.3 Sanctions & restricted regions. We do not provide payment or payout services in jurisdictions, entities, or to persons subject to sanctions or legal restrictions. We may geo-block or disable transactions at any time to comply with law.Merchant of Record & Payment Processors
2.1 Merchant of Record. Unless otherwise stated at checkout, FOS Social acts as merchant of record for purchases on the Platform.
2.2 Payment processors. All purchases are processed exclusively through in-app purchases via the Apple App Store or Google Play Store. These providers tokenise and store payment credentials; FOS Social does not store full card numbers.
2.3 App stores. The Apple App Store or Google Play Store is the billing counter-party for all transactions. The store’s billing rules, receipts, renewals, and refund processes apply and may override portions of this Policy for the affected purchase.Types of purchases
3.1 Creator Subscriptions. A recurring fee for access to a specific Creator’s subscriber-only content, messages, perks or benefits described by that Creator.
3.2 One-off Paid Content (PPV). A single payment to unlock a specific item (e.g., a post, video, stream).
3.3 FOS Social Premium / Premium+. Optional Platform subscriptions offering additional features and monetisation benefits as shown in-product. All purchases are made via in-app purchase through the Apple App Store or Google Play Store.
3.4 Picks Packs. Prepaid vote packs that allow you to cast Picks as described in the Picks Program. Picks Packs are purchased via in-app purchase through the Apple App Store or Google Play Store, or included as part of Premium and Premium+ packs.
3.5 Other paid features. From time to time we may offer additional paid features. We will describe the price, term, and applicable rules at point of sale.Pricing, currency, and tax
4.1 Displayed prices. Prices are shown in EUR by default unless otherwise indicated. We may display or charge in other currencies using network or processor FX rates and a modest spread to cover conversion costs.
4.2 Taxes. Where legally required, we may calculate/collect VAT/GST/sales taxes on buyer transactions and show tax-inclusive pricing when required (e.g., EU). Creators are responsible for their income/self-employment taxes.
4.3 Fees. We may charge service fees on transactions. Any fee will be disclosed at checkout or in your account settings.
4.4 Pricing changes. We may change prices and fees with notice where required by law. For auto-renewing purchases, changes apply from the next billing cycle after notice.Revenue share (Creators)
5.1 Default split. Unless a program says otherwise, Creators receive 68% of net receipt; app stores take 15%, and FOS Social takes 17%.
5.2 Exclusive Content Program. Approved Exclusive Content earns 70%; the first 1,000 approved accounts may lock 80% permanently (account-level, non-transferable, ID-tied).
5.3 Cap. The maximum Creator share is 85%. This cap does not apply to amounts withheld for taxes, app-store fees, chargebacks, refunds, penalties, or reserves.
5.4 Order of application (illustrative). The highest applicable program rate (e.g., Exclusive Content Program) applies first, subject to the 85% cap.Subscriptions: term, billing, and renewal
6.1 Auto-renewal. Subscriptions auto-renew monthly (unless a different term is shown) until you cancel. Billing is handled by the Apple App Store or Google Play Store at the start of each billing period.
6.2 Pre-renewal notice. For significant price increases or term changes, we’ll provide notice as required by law before the next renewal.
6.3 Managing subscriptions. You can cancel anytime in Account → Subscriptions (web/app). Purchases made via App Store/Google Play must be managed in those stores.
6.4 Effect of cancellation. Your access continues until the end of the current paid period; we do not pro-rate or provide partial refunds unless required by law.One-off purchases
7.1 Immediate access. One-off purchases (PPV) generally unlock immediately upon successful payment.
7.2 Gifts. If we offer gift subscriptions or gift purchases, they are subject to the same rules as the underlying product and may have expiry dates.Refunds & cooling-off
8.1 General no-refund rule. All sales are final: subscriptions (including renewals), PPV, and Picks Packs are non-refundable, except where we determine scam/fraud or a mischarge occurred, or where consumer law mandates a refund.
8.2 Digital content withdrawal (EU/UK). Where applicable, at checkout you may be asked to consent to immediate performance and acknowledge loss of the 14-day withdrawal right. If you do not consent, you should not proceed with the purchase.
8.3 App-store refunds. All refunds are controlled by the Apple App Store or Google Play Store; you must request them through those stores directly.
8.4 Service faults. If we cancel or materially fail to deliver a FOS Social-operated subscription without cause, we may issue a pro-rata refund for the affected period at our discretion.
8.5 Creator-promised perks. Creator promises (e.g., “weekly messages”) are agreements between you and the Creator. Your remedy is with the Creator, not FOS Social, except where non-waivable law requires otherwise.Chargebacks, disputes, and fraud
9.1 Creator liability. Creators bear the cost of chargebacks and related fees for their buyers.
9.2 Set-off & reserves. We may offset chargebacks, penalties, or refunds from your current or future payouts, place reserves/holds, delay payouts, or suspend monetisation if your dispute rates exceed acceptable thresholds.
9.3 Buyer misuse. Abusive dispute activity (friendly fraud) may result in account limits or termination.
9.4 How to dispute. If you believe a charge is wrong, contact support@fossocial.com promptly. For store purchases, contact the Apple App Store or Google Play Store directly.Failed payments & dunning
10.1 Retries. If a renewal fails, the Apple App Store or Google Play Store may retry your payment method and notify you to update details.
10.2 Access limits. If payment cannot be collected within a reasonable dunning window, we may suspend access to paid features until payment is resolved.
10.3 Stored methods. Payment credential storage is managed by the Apple App Store or Google Play Store in accordance with their respective terms.Creator Balance & Earnings Ledger
11.1. Ledger only. FOS Social maintains an internal Creator Balance ledger showing earnings and transactions. It is not a bank account, deposit, or e-money product. No interest accrues.
11.2. Withdrawable funds. Only earnings generated from monetisation and eligible transactions are eligible for payout once all verification and KYC requirements are met.
11.3. Negative balances. We may create or reflect a negative balance for chargebacks, refunds, penalties, or corrections and collect it from future earnings.Payouts to Creators
12.1 Eligibility. Payouts require: (a) verified identity; (b) completed payee/tax info; (c) passing KYC/AML/sanctions screening; and (d) meeting any minimum payout threshold.
12.2. Cadence, limits & methods. Payouts are bi-weekly. The minimum withdrawal is €10 and the maximum per withdrawal is €100,000. We publish available payout methods on the Payouts help page and may change methods with notice where required.
12.3 Holds & reserves. We may withhold payouts or apply rolling reserves for new or higher-risk accounts, elevated dispute rates, suspected policy breaches, or legal/regulatory reasons.
12.4 Corrections. We may correct processing errors by crediting or debiting your balance and/or upcoming payouts.
12.5 Dormant accounts. We may close dormant accounts after a defined inactivity period and attempt to remit any remaining withdrawable balances, subject to applicable law and fees.Discounts, referrals, and promotions
13.1 Referral discounts. Creators can set subscriber discounts within 5%–20% (minimum 5%): by default, the discount is taken from the Creator’s share unless the offer explicitly states it is platform-funded. Discounts apply only to subscriptions.
13.2 Cashback. Referral cashback and similar incentives are generally platform-funded and may be adjusted, capped, or withdrawn at our discretion. If lab If labelled ‘withdrawable,’ cashback may be paid out subject to standard payout and KYC rules; otherwise it is non-withdrawable and may only be used for eligible in-Platform activity.
13.3 Promo codes. Codes have limits (e.g., 5 redemptions, 30-day validity) unless specified otherwise. Expired or misused codes may be rejected.
13.4 No entitlement. Participation in promotions is voluntary. We may modify, pause, or end promotions at any time with prospective effect.Prohibited conduct (payments)
14.1 No manipulation. You may not manipulate subscriptions, purchases, Picks, referrals, ratings, or rewards via bots, duplicate accounts, collusion, or self-dealing.
14.2 No laundering. You may not use FOS Social to send or receive funds for unlawful activity or to circumvent sanctions, AML, or KYC rules.
14.3 Consequences. We may cancel transactions, claw back payouts/rewards, freeze balances, apply reserves, and suspend or terminate accounts for violations.Content access & IP
15.1 License only. Purchases grant a limited, revocable license to view the relevant Content on the Platform. No ownership or IP rights are transferred.
15.2 Availability. Content availability is not guaranteed and may change due to Creator decisions, moderation, rights issues, or technical reasons. We may provide a goodwill solution where we remove purchased PPV without cause, but we are not obliged to do so.
15.3 Sharing. Re-uploading, redistributing, or commercialising paid Content without permission is prohibited.Creator promises & platform role
16.1 Intermediary. FOS Social provides the platform and payment rails. We are not a party to Creator-Subscriber agreements about perks or content schedules.
16.2 No guarantees. We do not guarantee Creator output, response times, or earnings. Disputes about Creator promises are between Users (see Terms).App store terms
17.1 Store control. All billing, renewal, and refunds for in-app purchases are handled exclusively by the Apple App Store or Google Play Store. FOS Social cannot process or override store billing decisions.
17.2 Cancellation. You must cancel store purchases in the store settings. We cannot cancel them for you.
17.3 Price parity. Prices may differ between web and app due to store fees and policies.Security & authentication
18.1 SCA/3-D Secure. Where required (e.g., EU/UK PSD2), transactions may require Strong Customer Authentication (3-D Secure).
18.2 Account security. Keep your account secure. You’re responsible for charges made using your credentials unless you’ve promptly reported compromise.Taxes & reporting (Creators)
19.1 Your responsibility. Creators are solely responsible for reporting and paying income, self-employment, and other taxes resulting from their earnings.
19.2 Withholding. If a law requires withholding or documentation (e.g., W-8/W-9 equivalents), we may delay or withhold payouts until you provide the required information.
19.3 Statements. We may provide periodic statements or dashboards; these are informational only and not tax or legal advice.Errors, reversals, and adjustments
20.1 Right to correct. We may correct errors or reverse transactions where we reasonably believe a mistake, dispute outcome, or policy breach occurred.
20.2 Audit. We may conduct payment audits and ask you for cooperation and documentation.Data & privacy
21.1 Processing. We process payment data as described in our Privacy Policy.
21.2 PCI & tokenisation. Card data is handled by PCI-compliant processors (Apple App Store, Google Play Store) using tokenisation.
21.3 Fraud signals. We may use automated tools and human review to detect fraud and abuse.Suspension & termination
22.1 Failure to pay or verify. We may suspend paid access or payouts for failed payments, excessive disputes, policy breaches, or verification failures.
22.2 Effect. On termination for breach, you may lose access to paid features without refund. We may withhold balances to cover chargebacks, fines, and investigations.Changes to this Policy
23.1 Updates. We may update this Policy. Material changes will be notified via the Platform or email at least 30 days before taking effect unless law requires sooner. Continued use after the effective date means you accept the updated Policy.Complaints & help
24.1 Support. For billing issues, contact support@fossocial.com with your order ID, timestamp, amount, and a description of the issue.
24.2 Escalation. For store purchase disputes, you must contact Apple/Google directly.
24.3 Legal. This Policy is governed by the dispute and governing law provisions in the Terms of Service (including US binding arbitration and class-action waiver, where applicable).Definitions
Net receipt: the amount we actually receive for a transaction after processor/app-store fees, taxes collected on the buyer’s behalf, and any adjustments.
Reserve: an amount we hold temporarily to cover potential disputes, chargebacks, or penalties.
Set-off: our right to deduct amounts you owe (e.g., chargebacks) from amounts we owe you (e.g., payouts).
Creator earnings: withdrawable funds generated from monetisation activity on the Platform, transferable subject to payout and KYC rules.
Annex A — Program math guidance (non-contractual examples)
Example 1 (base): Subscription €10. Net after app-store fees/taxes received €9.50. Creator share 68% → €6.46 payout basis (subject to holds/offsets).
Example 2 (Exclusive Content, locked 80%): Same €9.50 net; Exclusive Content locked rate 80% → €7.60 payout basis.
Example 3 (Exclusive Content, standard 70%): €9.50 net; Exclusive Content standard rate 70% → €6.65 payout basis.
Note: Examples ignore reserves, refunds, and chargebacks. App-store commissions (15%) are already factored into the net receipt figures above.
Annex B — Cooling-off acknowledgement (EU/UK)
At checkout for digital content/services delivered immediately, we display:
“By completing this purchase, you request immediate access to the digital content/service and acknowledge that you lose your right of withdrawal (cooling-off) once delivery begins, to the extent permitted by law.”
